Section 19

What is Section 19 Duty (S19)?

Section 19 of the Education Act 1996 ensures that the local authority arranges suitable, full-time education where suitable, for children of compulsory school age who cannot attend school due to illness, exclusion or other circumstances.

When does S19 apply?

S19 duty is triggered when:

  • A child has been absent for 15 consecutive days due to health needs.
  • A child has 15 days of absence spread across an academic year due to health-related issues.
  • A child is permanently excluded, S19 applies from the 6th day of exclusion.

Who provides Alternative Education Provision?

  • AEP may be provided by:
  • - Oxfordshire Hospital School
  • - Meadowbrook College
  • - School, health and LA commissioned education providers

Do I need to provide medical evidence?

Medical evidence may be requested to help the school and LA tailor the best support for the child. If formal medical evidence is unavailable, the school and LA will:

- Consult health professionals involved in the child’s care.

- Consider alternative information to determine the most effective support.

How long does Section 19 support remain in place?

Since school provides the best environment for a child's academic, emotional, and personal development, the goal is to support reintegration as soon as possible. Review meetings will assess: - 

- Health status of the child

- Effectiveness of current provision

- Adjustments needed for continued support

- Next steps for reintegration back to school

The child’s health and educational needs will always remain the priority throughout the process.
